Kuotos Swim – Pool Swimming Lesson Terms & Conditions
1. Instructor & Delivery
Swimming lessons are delivered by Ian Cartwright, Swim School Owner, who holds the following qualifications:
IOS Level 2 Swimming Teacher
STA Open Water Coach
STA Open Water Rescue Qualification
RLSS Open Water Lifeguard
STA Swimming Teachers Rescue Award
Diploma in Cold Water Immersion
Level 2 Personal Trainer
DBS checked and fully insured
Lessons take place at the allocated time and venue as communicated by Ian at The Stone House Hotel or Swim Cave.
Additional lessons may be delivered by self-employed teachers working under the Kuotos Swim brand. All instructors are selected for their experience and suitability to deliver lessons to our clientele.
2. Lateness
If you arrive late for a lesson, the lost time cannot be made up, as lessons run back-to-back.
3. Payment
Payment is due 7 days prior to the first lesson of a block, unless otherwise agreed.
Payment is made via bank transfer.
One-off individual lessons may be paid for on the day by cash, card, or bank transfer.
A lesson space is only secured once payment has been received.
4. Cancellations by Kuotos Swim
We reserve the right to cancel lessons due to:
instructor illness
holidays
personal or unforeseen events
Where lessons are cancelled by Kuotos Swim:
Paid lessons will be honoured and carried forward
As much notice as possible will be given (normally more than 7 days)
If lessons are cancelled due to circumstances outside our control (e.g. weather, pool issues), paid lessons will also be honoured.
5. Bad Weather (Pool Lessons)
As lessons take place indoors, sessions will normally run as scheduled.
If you cancel due to bad weather and the lesson goes ahead, the lesson will be charged.
If Kuotos Swim cancels due to weather or safety concerns, the lesson will be honoured.
6. Cancellations by You
Blocks consist of 6 lessons to be used within 7 weeks, starting from the date of the first lesson.
(Kuotos Swim holiday periods are not included in the 7 weeks.)Cancellations must be made at least 48 hours before the lesson.
One cancelled lesson per block may be carried forward if sufficient notice is given.
Any additional cancellations, including holidays, will be charged.
Cancellations within 48 hours will be forfeited.
Non-attendance without communication will be charged.
Block payments are non-refundable. This does not affect your statutory rights.
7. Partial or Disrupted Sessions
If a session is shortened or disrupted due to unforeseen circumstances (e.g. technical or safety issues), it will normally be considered delivered. Credits may be offered at the discretion of Kuotos Swim where appropriate.
8. Communication
Communication will take place via WhatsApp.
Groups are created for each day and used for one-way communication only.
Replies should be sent privately to Ian.
If you do not wish to be part of a group, this must be indicated on the registration form.
Parents/guardians are responsible for checking messages before travelling.
Failure to attend a lesson that goes ahead as scheduled will be charged.
9. Swimmer Health & Illness
Parents/guardians or swimmers must inform Kuotos Swim of any medical conditions, injuries, or additional needs.
Swimmers must not attend lessons if:
they are unwell
they have had sickness or diarrhoea within the previous 48 hours
10. Supervision & Changing Areas
Parents/guardians are responsible for children at all times outside of lesson delivery, including in changing rooms and poolside areas.
11. Behaviour & Conduct
Respectful behaviour is expected from swimmers and spectators at all times.
Kuotos Swim reserves the right to remove any swimmer or spectator whose behaviour is disruptive or unsafe. No refund will be given in such circumstances.
12. Photography Policy
Parents may take photos or videos of their child only if the following rules are adhered to:
Images must contain your child only
No wide-angle shots of the pool
No other children or adults in images
No photography when other children are in the pool
By taking photos or videos, you confirm that you and the instructor may appear in the images.
13. Liability
While every effort is made to ensure safety, participation in swimming activities is at the swimmer’s own risk.
Kuotos Swim does not accept responsibility for loss or damage to personal belongings.
Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, or any other liability which cannot be excluded by law.
14. Changes to Terms
Kuotos Swim reserves the right to amend these Terms & Conditions at any time. Updated versions will be made available.
Enrolment in lessons constitutes acceptance of these Terms & Conditions.
Open Water at Whitmore Lakes
Kuotos Swim welcomes you to our open water swimming venue at Whitmore Lakes. To ensure a safe and enjoyable experience for all participants, please read and adhere to the following Terms & Conditions.
1. Assumption of Risk
Open water swimming is a physically demanding activity and involves inherent risks, including cold water exposure, changing weather conditions, and physical exertion.
All swimmers enter the water at their own risk and accept responsibility for their participation.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence.
2. Authorisation & Supervision
Swimmers must not enter the water until authorised by a member of staff.
Swimmers must:
Enter and exit the water at designated points
Swim only during their allocated session time
Exit the water immediately when instructed
All instructions given by Kuotos Swim or Whitmore Lakes staff must be followed at all times.
3. Course Rules
Swimmers must remain within the designated swim route unless instructed otherwise.
Swimming direction is anticlockwise.
Do not obstruct, interfere with, or endanger other swimmers.
Diving is strictly prohibited.
4. Equipment & Clothing
Wetsuits are strongly recommended for warmth and buoyancy.
A brightly coloured swim hat must be worn at all times.
Goggles are recommended but not compulsory.
Neoprene gloves and socks may be worn.
It is the swimmer’s responsibility to ensure all equipment is suitable and safe for use.
5. Ability & Fitness
All participants must be able to swim at least 50 metres unaided, except for Introduction to Cold Water Immersion sessions.
Swimmers must be physically and mentally fit to participate.
A medical declaration form must be completed on each visit.
You must not swim if:
You are feeling unwell
You have a medical condition that makes open water swimming unsafe
If you have a heart condition, high blood pressure, are pregnant, or have any other relevant medical condition, you must seek medical advice before swimming and will be required to confirm this. If you are unable to do so, please do not book a session.
If a swimmer becomes unwell during a session, they must leave the water immediately and inform a member of staff.
6. Emergency Procedures
In the event of difficulty, swimmers should:
Roll onto their back
Raise one arm in the air to signal for assistance
7. Bookings & Payments
All sessions must be booked in advance.
Payment must be made at the time of booking and is non-refundable.
Sessions cancelled by the participant are non-refundable and non-transferable.
If a session is cancelled by Kuotos Swim due to weather, safety, or operational reasons, a credit will be issued.
8. Weather & Operational Changes
Kuotos Swim reserves the right to:
Close the lake
Amend course dimensions
Cancel sessions
This may occur due to weather conditions, safety concerns, or maintenance. Where possible, notice will be given.
9. Children & Young People
All children under 16 must be supervised by a responsible adult at all times while on site.
Children under 16 must be accompanied in the water by an adult.
An adult standing at the water’s edge is not sufficient supervision.
10. Photography & Media
Photography or video may be taken during sessions for promotional purposes.
If you do not wish to appear in images or video, please inform a member of staff before entering the water.
11. Conduct
Threatening, aggressive, or unsafe behaviour will not be tolerated.
Kuotos Swim reserves the right to remove or ban any participant who breaches these Terms or behaves unsafely.
No refund will be issued in such circumstances.
12. Personal Property & Parking
All personal belongings are left at the owner’s risk.
Free parking is available but vehicles are parked entirely at the owner’s risk.
Please park only in designated areas.
13. Liability
Participants are responsible for their own actions while on site, including entry and exit from the venue.
Kuotos Swim and Whitmore Lakes accept no responsibility for loss or damage to personal property.
14. Changes to Terms
Kuotos Swim reserves the right to amend these Terms & Conditions at any time.
